Article 1:

 

These conditions of sale are applicable to all contracts concluded between on the one hand, SA Corman Collins, whose registered office is Rue de Verviers n ° 76 4651 Battice, registered with the Banque Carrefour des Entreprises under number BE0430.414.437 ci -after referred to as "the seller" and, on the other hand, any professional buyer or any consumer wishing to make a purchase via the seller's website, hereinafter referred to as "the buyer".

Professional buyer: any natural or legal person not falling within the definition of consumer in the previous paragraph

These conditions of sale aim to define the contractual relationship between the seller and the buyer as well as the conditions applicable to any purchase made through the seller's site, whether the buyer is a professional or a consumer.

The acquisition of a good or a service through this site implies unreserved acceptance by the purchaser of these conditions of sale.

These conditions of sale will prevail over all other general or special conditions not expressly approved by the seller.

The seller reserves the right to be able to modify its conditions of sale at any time. In this case, the applicable conditions will be those in effect on the date of the order by the buyer.

Each product is accompanied by a description established by the supplier.

Article 4: Prices

 

The prices of the products and services displayed on the site are indicated in euros all taxes included (VAT and other applicable taxes).

The prices indicated do not include transport costs, these being the subject of an additional item when ordering.

The seller reserves the right to modify its prices at any time. However, the prices applicable to the order are those in effect at the time of confirmation thereof.

Article 5: Geographical areas

Products purchased on www.corman-collins.be are only delivered to the countries indicated on the site. They will be delivered to the address indicated on the order form. SA Corman-Collins cannot be held responsible for the consequences due to a delay in delivery linked to the responsibility of the post office. There will be no refund of the order as long as it is not returned to the sender or arrives at the recipient late.

In the event of payment by bank transfer, the order will only be processed upon receipt of the amount. Consequently, the deadlines applicable in this case are those on the day of receipt of payment and may therefore be modified compared to those mentioned on the day the order is placed.

If you decide to cancel your order after payment and your order has already left for delivery, Corman-Collins SA will only refund this product upon full receipt. You are strongly advised to return the product in its original condition.

Any order placed by a buyer on www.corman-collins.be is subject to these General Conditions of Sale to the exclusion of any other document, in particular the buyer's general conditions of purchase.

All clauses and conditions contrary to these General Terms and Conditions of Sale appearing on order forms and more generally on any type of correspondence from the buyer will be deemed unwritten and will have no contractual value between the parties. These General Terms and Conditions of Sale can only be waived by express written consent of SA Corman-Collins.

The products are described by the information given on the technical sheets.

The photographs on the product sheets are for illustration only, the product may differ from what is displayed. The information provided by the photographs does not bind SA Corman-Collins, who may modify them at any time.

SA Corman-Collins reserves the right to correct any accidental material error or any omission in these Conditions, as well as in any other contractual document.

SA Corman-Collins offers products marked “Rarities / Collectors” on corman-collins.be. Rarities / Collectors are products which by their nature are available in very limited quantities, in particular but not limited to the exhaustion of stocks, the disappearance of the distillery, the seniority of their productions, the exceptional qualities of the product. They are very valuable, fragile and irreplaceable products. The acquisition of these products by the purchaser on corman-collins.be is subject to conditions derogating from all other orders. These conditions are specified in these general conditions of sale.

The products are offered and delivered within the limits of available stocks.

In the event of unavailability of the ordered product, SA Corman-Collins informs the buyer and can offer him a product of equivalent quality and price or, failing that, a credit for the amount of the order usable on www .corman-collins.be.

5.2. - Risk transfer

 

Ownership and risks relating to your products will pass upon receipt of the Products.

 

5.3. - Tariffs

 

When you order products to be delivered to a country other than Belgium, you are considered the approved importer and must therefore comply with the laws and regulations in force in the country in which you receive the goods.

You may be subject to import duties or taxes when goods arrive in your country. All additional customs clearance costs are your responsibility. Sa Corman-Collins has no control over these charges and does not know their amount. Article 6: Orders

 

The buyer, who wishes to buy a product or a service, must:

The invoiced prices of the products are those appearing on the www.corman-collins.be on the date of the confirmation of the order by the buyer.

SA Corman-Collins reserves the right to modify the prices in force on www.corman-collins.be at any time. The price change will automatically apply on the date of publication of the price change on www.corman-collins.be.

All orders, whatever their origin, are payable exclusively in Euros.

No shipment of merchandise will be made without confirmation of the order and receipt of full payment for the order.

The products and services are offered within the limits of available stocks. In case of unavailability of an item, the seller will inform the buyer by email as soon as possible. Article 7: Right of withdrawal

The products must be returned in their original packaging, undamaged, accompanied by all their accessories, the user manual as well as the original invoice / delivery note.

The returned products must not have been unpacked, unsealed or used in any way.

Incomplete, damaged, damaged or soiled goods by the customer will not be taken back.

Within 30 days, after acceptance of the return of the goods, the seller agrees to reimburse any payment, with the exception of shipping costs.

Article 8: Terms of payment

 

Payment is made by credit card, Visa or Mastercard, bank transfer.

Article 9: Deliveries

 

Deliveries are made to the address indicated on the order form, which can only be in the geographical area mentioned above; by collection at a delivery point of the buyer's choice when ordering.

In the event of absence during delivery to the address communicated by the buyer, the latter can contact the seller within 48 hours in order to agree on another delivery date. Failing this or if the buyer omits or refuses to take delivery of the goods ordered, the seller reserves the right to demand the execution of the contract or to consider, after prior notice, it as being automatically terminated. to the wrongs of the buyer. In the latter case, the seller will retain an amount equivalent to 30% of the sale price as compensation.

In the event of sale to a consumer, the goods are transported at the seller's risk until delivery of the goods to the delivery address specified by the buyer. From that moment, the buyer alone assumes the risks. In the event that the delivered goods are damaged, the buyer is obliged to refuse the goods or to accept them only with a written reservation on the carrier's delivery note, to be completed together by the customer and the carrier. Any complaint relating to the goods delivered must be received by the seller within 5 days of the date of receipt. The complaint must be sent exclusively by registered letter to the head office: SA Corman-Collins, 76 Rue de Verviers 4651 Battice and be accompanied by a copy of the purchase invoice and the delivery slip completed with the written reservation mentioned above. . In the event of sale to a professional, transport is at the risk of the buyer.

In the event of a delay in delivery, if it is at least fifteen working days and only as part of a non-personalized order (item regularly in stock), the buyer may renounce his purchase without compensation, for neither of the two parties, provided that he notifies the seller by e-mail within 3 days of the seller's notification of the delay in delivery. The buyer will then be reimbursed by bank transfer to his bank account for the total amount of his order including transport costs (if incurred during the order) within 15 working days. In all cases, the following circumstances release the seller from his obligations in terms of time:

Delivery costs are free from purchases of € 130 including VAT, for delivery addresses located in Belgium only. They are free from € 199 of purchases including VAT, for delivery addresses located in Germany, the Netherlands, France and Luxembourg.

In any event, SA Corman-Collins reserves the right to impose on the buyer a carrier and delivery costs, due to the particularity of the products

3 - If changes are decided by the customer after the order.

 

4 - If the customer does not provide us with the desired information within the specified period.

 

Article 10: Guarantee

The invoice or the delivery slip serve as a guarantee and must be kept by the consumer and produced in original.

The professional buyer benefits from the manufacturer's warranty.

 

Article 11: Responsibilities

 

The seller, in the online sales process, is only bound by an obligation of means; it cannot be held liable for damage resulting from the use of the Internet network and online payment such as loss of data, intrusion, virus, interruption of service, or other unintentional problems.
